Did the idiot Holder ever stop to think that KSM might actually be acquitted? He might end up returning to Pakistan to plot anew. Obama is doing this to “put the US on trial”. He may wind up putting his administration on trial.

Being a judge (not US though…) i know how difficult a trial before a normal court will be. I think its wrong to go to a “normal”, civil court. If you try these guys as ordinary criminals, there are a gazillion of legal questions every defense lawyer will exploit.
Was he read his rights? Was he tortured and should the whole case not be thrown out because of this? Was there a legal arrest warrant, signed by a judge? Was the detention legal, was he denied acess to a lawyer?

Also, all CIA intelligence cannot be used in a court, because either it is not legally obtained (listening to cellphone conversations in Pakistan was probably not ordered by a judge…) or because it would endanger their sources.

These people are on a self declared war against the west and should be tried as war criminals.

This decision is strategically wrong. You will get a trial that lasts for years, costs the taxpayer millions with an uncertain outcome.

I remember the case of Mounir El-Motassadeq over here, that lastes for years, cost millions and they even let that guy go free because of the lengthy proceedings ( he got 15 years prison after all, a small price to pay for being involved in a terror plot with more than 3000 victims but the highest sentence possible under criminal law).

Debbie, Janine Piro, lawyer and former (I think) AG of NYS said on FOX News that any federal judge will be forced to throw out the case based on the violation of the Miranda rule alone. Is that true? Would he/could he be set free just from that?

KSM will put the United States on trial because that is what KING HUSSEIN OBAMA wants. They want to get indictments out of the Bush Administration. Also the new picture of KSM is driving libs crazy. For all the libs wants to portray Muslims as peaceful then he pulls an “Osama” with the long beard and menacing look. Libs not posting his new photo.d And we are supposed to feel sorry for waterboarding a guy who looks like Osama and has killed for Osama? Just wait till Hasan goes full “Osama”. Too bad for libs that KSM and Hasan both are alive because they will destroy the libs BS storylines.

This trial will be a complete mess and allow the defendant to grandstand before a world audience. KSM has already admitted his guilt, and is in fact quite proud of what he has done. So, why even hold such a trial?
