The Ignoramusette Doesn’t Understand Why Roe v. Wade is Bad Law, Can’t Think of Single Supreme Court Case She Doesn’t Like

By Debbie Schlussel
To all the blind so-called conservatives who gush over Sarah Palin at every ignorant utterance, I’m sure you’ll continue to gush as Palin demonstrates her complete lack of understanding of the objection to Roe v. Wade as bad law. And I’m sure you gush as she demonstrates that, heck, she can’t think of a single decision by the Supremes that she doesn’t like other than Roe (because she hasn’t a clue).
Palin tells Katie Couric that she believes there’s a “right to privacy” in the U.S. Constitution. But, in fact, that’s the whole conservative objection to Roe v. Wade. Justice Harry Blackmun simple made it up, to legally protect abortion–something he readily admitted to Bob Woodward for a Woodward book. There is no right to privacy in the Constitution. It’s pure fiction. If you believe there is, then you believe in abortion on demand and a whole host of other things strict constructionist conservatives oppose. You don’t make up stuff in the Constitution that ain’t there–it’s that simple. Well, simple for anyone with even the tiniest bit of knowledge about basic national issues, like abortion.

You expect a person running for Vice President–especially one claiming to be a conservative and pro-life–to know these things, like about the right to privacy being created out of wholecloth. She doesn’t because she’s a complete ignoramus. (Oh, and she also opposed a pro-life bill in Alaska. She talks a conservative game, but didn’t follow one.)
You also expect a person running for Vice President to know of a few Supreme Court decisions, other than Roe, with which she disagrees. I can rattle several off the top of my head because I actually read a newspaper and follow the news. She doesn’t, and yet she wants to lead the country.
For instance, I oppose the Supreme Court’s decision to grant habeas corpus petition rights and access to U.S. courts to Guantanamo Bay inmates who aren’t even on U.S. soil and have no nexus to America. For a woman who claims she wants to stop Islamic terrorists, why doesn’t she know about this recent, prominently awful decision? I also oppose the Court’s ruling that a non-adult, no matter how heinous his crime, cannot face the death penalty. The University of Michigan affirmative action cases with opposite resulting decisions, Grutter and Gratz. And there are so many others . . . so many others about which she’s clueless.
Yup, can’t wait until she’s Veep. Don’t look for her to make frequent TV appearances like Dick Cheney, a smart guy who actually knew what the heck he was talking about.
But, hey, she’ll be great at funerals of foreign leaders and cutting ribbons at openings.
Like I said earlier in the week, Sarah Palin can only exceed expectations at the debate tonight. Her performance thus far has been that dismal.
Remember when conservatives objected to Bush’s nomination of Harriet Miers to the Supreme Court? Harriet Miers was supposedly a conservative and a knowledgeable woman. But she simply didn’t have any experience as a Judge nor the qualifications to sit on the Supreme Court. It’s the same deal here, except the woman is question is a gazillion times more ignorant.
Like I said before, the choice in November is between two horrible Marxist blowhards and a liberal-centrist Republican with a complete ignoramus. Good luck, America.

You’ve got it all wrong…
She reads ALL of the newspapers and magazines!

Last night the maverick threw away his signature theme and opted to be the same as the rest of the Beltway Crowd. If he does lose the election, that will be seen as a turning moment. Voting for earmarks and pork on top of increasing the national debt and raising taxes $2,600 on every Middle American family to pay to relieve the distress of a couple of banks isn’t a profile in courage; its a profile in cowardice. Should Palin be asked the question tonight, how can she credibly say her boss is different from Obama and the rest of the tax and spend Washington crowd? She can’t. Even if she knows next to nothing about Roe, she hitched her star to a moderate liberal for whom expediency (that’s why he voted like a socialist) rather than principle (what the dictionary definition is of the true maverick) is the greatest thing in politics. At least Obama doesn’t pretend to be a phony maverick.

I, too, am frustrated that she could not name Supreme Court decisions – e.g. Kelo. But remember this part. There is a difference between those with basic conservative values and those without them. Regardless of how much knowledge she has right now, she has the right values. She can always learn the facts. I would rather have a pro-life, Washington hating, anti-tax, gun carrying uneducated person from any trailer park serving as president than any current Washington insider. Palin can learn the cases. I was conservative before I could name Supreme Court cases. Obama-Biden cannot learn values.

salt1907 on October 2, 2008 at 12:47 pm

I guess you must consider Samuel Alito and John Roberts to be ignoramuses too, because both said at their Supreme Court confirmation hearings exactly what Palin said — that they believe the Constitution contains, in SOME sense, a “right to privacy.”
The question is not whether privacy is guaranteed in any way by the Constitution — clearly it is, otherwise the 4th Amendment makes no sense — but whether the privacy rights granted by the Constitution entail a constitutional right to abortion.
I don’t necessarily disagree that Palin’s performance has been disappointing, but what she said about privacy doesn’t establish anything.

JPSmith on October 2, 2008 at 1:31 pm

salt907 has got it right.
Moreover, as Debbie would probably agree, most “landmark” Supreme Court cases, although they may have profound consequences, are essentially crapola in terms of logic and reasoning.
Also, while many people can name cases, and the precedent created, almost no one–including con lawyers–know the details of the cases.
The other funny thing about con law is that precedent is all important, except when it’s not.
As to “ignoramus,” compare Palin as a soccer mom with a good heart, to Obama, who *was* a law prof, and yet never wrote an article in his life.
Right now, I’d settle for a pres and VP. who just aren’t thugs like Obama, or dummy legislators like Biden.

Sarah Palin has more executive experience than Barack Obama, but more importantly, she has shown better judgment; mainly by not cozying up to terrorists like Bill Ayers, radicals like Jeremiah Wright, or criminals like Tony Rezko.
The worst lies about Sarah Palin are still better than the plain truth about Barack Obama.

The only reason I’m “gushing” (though thats NOT what I’m doing) over Palin is because I thought she might help McCain beat Obama.
The only thing important in this election is to keep that LYING fraud out of office.
And if that means electing an ordinary soccer mom who knows less than I do about the law then so be it.

robscottw on October 2, 2008 at 1:55 pm

Unfortunately this could be the game clincher for Obama. With all the weaknesses of Palin out there, Biden will finish her off with a Kill Shot right between the eyes with that classic arrogant grin he has. The first mention of Hillary by Palin, Biden will unload the “I know Hillary, Mrs.Palin You arent no Hillary Clinton” Her lack of knowledge of specifics will just show how clueless she is. Biden will speak over her. He will just rattle off leader’s name, Supreme Court justice names, politician names and Palin will be asked to rebutt the specifics and she will dance and give generalities. Biden will ignore her and speak to the people and let her struggle.
In the end Obama will get another bump in the polls and it will his to lose. This will set off the beginning of the demise of the rest of the country. What San Francisco wants San Francisco will get. Remember Pelosi is from San Fransicko. It is happening here in California and the rest of the nation will get this perverted dose of governance. Mandates by the Federal Government into State and Local Communities will shock small towns. Because the Republicans lack of convictions and passions, exemplified by Bush, the Party will loose more seats in Congress. So marginalized, the Republicans message will be seen as a throwback to the Neanderthal days. Will conservatives ever get back? When conservatives quit apologizing for holding their beliefs. When conservatives are proud of their of beliefs. When conservatives quit going along to get along to make nice or make friends. When conservatives go after those that choose to marginalize them. Conservatives saw Palin as this savior but now it seems to be a mirage. We wanted the barracuda. She has been bottled. She has been crafted to seem likable to the liberal media. Liberals feared her at first because they saw a tenacious woman. Hopefully for our sake, she is unleashed and not be afraid to make mistakes. You can win arguments without the specifics, as long as the people see the passion and the convictions that you care and they relate with that. Reagan was never great on specifics but America knew he was raw with convictions and passion.

I’m going to reserve judgment until I see what happens at the debate tonight. If she even comes close, it will be a victory for her, given the non-objective attitude of Ms. Ifill. I wonder whether someone on the McCain campaign intentionally sabatoged her by setting her up with Ifill. I can’t believe they wouldn’t have known about her book. It defies logic.
I would, of course, feel more comfortable if she had known about these decisions, although I’m not sure she should be compared to you, since you are an attorney and someone who writes comprehensively about these issues & has expertise. However, she has lived an anti-abortion life, and that may be more iimportant than whether she understands the logic of Roe v Wade.
Harry Truman was a Senator for more than a decade before he became President. He knew little about foreign policy or Supreme Court decisions before he became President. He was not perfect — he relied too much on the Eastern elite, and, arguably this caused the Korean war among other things. nevertheless, he was much better than Roosevelt on the Mideast, and foreign policy in general, in spite of Roosevelt’s far greater sophistication. It didn’t take him long to understand the Soviet Union, and although he was soft on Communists in the Government, he wasn’t alonoe. Virtually the whole Washington establishment except for joe McCarthy and a few others were the same way.
I still think Palin has good instincts, and in the long run that may be more important. I think we’ll learn more tonight.

She does know about it. During the Convention speech she talked about “reading them their rights”. Remember that Debbie? Or, are you so filled with hate that you didn’t bother with the Convention speech?
Calling people names is rather mean-spirited. I suppose you are getting it all out of your system before next week.

BULLSHIITE. Katie Curic’s in the Obama shark tank, and just another political hack trolling with blood in the water. Anyone can formulate “gotcha” trip wire questions, and keep pressing to make a person look like Alfred E. Newman.
The problem with McCain, Pailin and the MSM are, the MSM hate conservative republicans, and will do everything in their power to sink McCain, and get their socialist/Marxist coke snorting Obama-Turd elected. There have been unprecedented Obama MSM cover up. They are longer news organizations, but in fact, biased political lobbyists.

Jackson Pearson on October 2, 2008 at 4:24 pm

One more thing about the MSM and unreported news.
Many people out there are clueless that Barack Hussein Obama, the DNC, and the Federal Elections Commission are being sued by Pennsylvania attorney Philip Berg, in U.S. District Court, No. 08-cv-4083, Eastern District of Penn.
In a short nut shell, Berg is alleging that Barack Hussein Obama is a non U.S. citizen, and in fact, an illegal alien. Moreover, Berg is demanding in accordance with article II, to the U.S. Constitution, that Obama prove U.S. citizenship. I’ve been following this case, and JMO, I don’t think Obama can prove it. Further, Barack Obama has just recently admitted on his web site, to having dual Kenyan citizenship. BHO made no mention of his Indonesian citizenship, of which is also included in the lawsuit.
So far on this story from the MSM – (((CRICKETS)))

Jackson Pearson on October 2, 2008 at 4:48 pm

My head is spinning. With the left and the MSM so out to do Palin in, why can’t we show some loyalty to her and wish her the best. I like her and like what I saw from the start. I don’t care if she went to 50 different colleges, infact I don’t care if she was just a high school graduate. I went to the University of Hard Knocks so I respect someone who comes form a similar background…middleclass family, wife, mother and conservative. People want change…she is it. I think right now we have to many people in Washington who can drop names and SC rulings like average people can football players or Dancing with the Stars names. I would like to see someone who is just one of the little people on top just once. We have some serious issues in this country and I fear Obama more then I fear Palin’s lack of knowledge.

formerwm on October 2, 2008 at 5:02 pm

Dear Debbie;
This is truly amazing. I can name several completely stupid, and totally wrong decisions by the so called “Supreme” Court. And I am waaaaaay more “Joe Six-Pack” than Sarah Palin is.
First. Every gun law in the United States of America, that seeks to minimize, a persons right, or ability, to keep, and bear arms, is grossly unconstitutional. And I think there are about twenty thousand of them.
Second. There’s that Supreme Court ruling that gave Masachusetts?? The right to take the property of a private citizen, and give it to a business, who will then pay much higher taxes to the state, and local government. This is a glaringly wrong interpretation of eminent domain.
Third. The McCain-Feingold bill.
Fourth. The Dred Scott Decision.
And then there is that ruling that came about only after one, or two of the Justices consulted European laws. And I seriously don’t give a damn about European laws with regard to our Constitution.
Now if I can come up with these off the top of my head, why can’t she?
However. Regardless of what faults Mrs. Palin may have, I will never, ever vote for a Marxist, who is loved the world over by Muslims, and other evil communist.
Sincerely;
EJO
P.S. A belated, but honest Happy Jewish New Year, to you, and your family. I hope you all had a wonderful time.

First you criticize Sarah Heath Palin for a harmless T shirt she wore when she was a teenager, then for being a working mother – face it there is something about her that just ticks you off.

samurai on October 2, 2008 at 8:44 pm

I’d vote for Yoko Ono in drag before I’d vote for Obama. The key for me is that Palin has the right gut instinct that resonates with the working stiffs of this country. She might not be a whiz at Legal Jeopardy questions, but alas neither was Reagan.

zonkerharris on October 2, 2008 at 9:56 pm

While this debate goes on and all the man haters who only will listen to this debate but no other one (some of the women who I know are listening to this one didn’t listen to any of the McCain Obama debate) but anyway while this is going on we are going to be screwed with this 600 billion dollar bailout that McCain is supporting and even said that we can go around congress and take a trillion dollars. Either way we are seriously screwed and please Palin is no fiscal conservative. THe town she was mayor of is in 22 million dollar debt because of a statium she wanted built. Palin only surrounds herself with her own yes men. Why doesn’t she as a so called conservative women speak about the fatherhood crisis in this country since at least as a women she can say it while if men say it they can claim they only care about themselves but not women. So please yes she is pro life and pro gun. But other then that from what I can see she is a liberal. And her church believes in female pastors so I don’t think she would really like Orthodox Judaism that only has MALE RABBI’S although most Orthodox Male Rabbi’s treat rank and file men that aren’t in their clique the way an antisemitic male ruler would but that is a story for another day.

If we care about our country or the Constitution then the upcoming vote tomorrow (Friday, Oct. 3rd) on the bailout of Wall Street is of utmost importance – even more important than the upcoming election. Long after either Vice-President Biden or Vice-President Palin is gone from the scene, we the people will have to deal with the terrible ramifications of a bailout plan that could be passed tomorrow. Needless to say, it was the unlimited printing of money out of thin air by the unconstitutional Federal Reserve that is the root cause of our declining standard of living that we are now all suffering from (except for the super-rich bankers and elitists).
The current plan is actually worse than the one rejected by the House. It used to be 3 pages long – now it is 451 pages long due in part to the more than $1.7 billion worth of “sweeteners” or pork included within the bill – to see examples of the outrageous pork click on
http://www.nypost.com/seven/10022008/news/nationalnews/piggy_pols_in_hog_heaven_with_pork_packe_131770.htm
The bill also contains many serious problems and loopholes – see
http://www.lewrockwell.com/blog/lewrw/archives/023294.html
The bailout bill will also result in “total financial dictatorship” – click on

The American people must once again rise up and voice their opposition to this “rescue plan” for the super-rich bankers and elitists.

I find Debbie’s hostility towards Sarah Palin perplexing. The problem is McCain, not Palin. Sarah Palin is his only hope for defeating B. Hussein. Of course she’s not perfect but at least she has good instincts.

lexi on October 3, 2008 at 12:35 am

I thought Palin did slightly better than Biden in the debate, and I did cringe when she said nucular, and then repeated it several times, in case anyone missed it. I thought a performance this good in the face of the pressure and character assassination she has faced was remarkable.
Ifill was biased, if only by omission; no questions about abortion, which would have given Palin a chance to talk about her life. One thing that did irritate me was her closing statement; a brief comment implying opposition to spending a trillion dollars, made at the end when she would not have to elaborate; i.e. the best of both worlds. If she is opposed, say so clearly. I hope this wasn’t a one-liner to try to soothe the base on this issue, but I am afraid that it was, and it’s really a little insulting.

c f on October 3, 2008 at 1:00 am

Hell yeah Ifill was biased. Not a single question on energy policy — one of the top 3 issues of this election cycle — because she knew Palin would OWN Biden on the topic. Same with abortion and gun rights.
Say what you want about Sarah Palin, but she’s the only thing standing between us and at least 4 years of Barack Obama, because McCain can’t win this election on his own. Palin is a big net plus to the ticket and she proved it last night.

JPSmith on October 3, 2008 at 11:15 am

Debbie,
I am not gushing over Sarah Palin but I think you are being overly critical of her. I think she did very well in the debate. Obviously, she needs to stay away from mainstream media interviews but she is not as bad as you make her.

cj on October 3, 2008 at 11:22 am

Debbie,
McCain-Palin or TheOne-TheMouth
These are the choices. Or are you backing an independant, just to lose your vote? Granted McCain is losing ground, but it is due to his vote on the Crap sandwich bailout bill and not because of Palin. I wonder if Congress will repeat and actually listen to Americans for the pork bill today.
